As material consideration for the sale and/or installation by Kickstart Heavy Duty Services Inc (RIMFIRE BRAKE AND WHEEL PROTECTORS) of our aftermarket wheel & brake protectors/services related thereto, the purchaser agrees as follows:

DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the RIMFIRE BWP products and services are provided on an “as is” and “as available” basis and the entire risk of installation, use and performance remains with you. RIMFIRE BWP hereby disclaims any implied conditions of merchantability, merchant quality, safety, durability, of fitness for a particular purpose. If you are dissatisfied with the RIMFIRE BWP product or services, your sole remedy is to discontinue using the RIMFIRE BWP services or products.

DISCLAIMER OF CERTAIN DAMAGE
To the maximum extent permitted by law, in no event will RIMFIRE BWP be liable for any incidental, consequential, exemplary, punitive or special damages. This includes revenue, profits, property, injury, death, failure to meet a duty of good faith or reasonable care, negligence, and any other loss whatsoever arising from or relating to RIMFIRE BWP services and products.

LIMITATION OF LIABILITY AND EXCLUSIVE REMEDIES
To the maximum extent permitted by applicable law, RIMFIRE BWP’s maximum, aggregate liability to you and your exclusive remedy under this Release and Disclaimer for any and all damages, injuries, and losses arising from any and all claims and causes of action arising out of, based on, resulting from or in any way related to the RIMFIRE BWP services or products will not exceed the amount paid by you to RIMFIRE BWP in connection with the RIMFIRE BWP services or products.

RIMFIRE BWP recommends a certified technician to install our products. Professional knowledge of disassembly and reassembly as well as post installation checks must be followed. Attempts to install our products without expertise and knowledge may lead to unsafe operation of the vehicle. The purchaser expressly agrees to indemnify and hold harmless RIMFIRE BWP for all claims resulting from the purchase, ownership, or use of our products.
